Participants will learn how the Workplace Safety and Insurance Board (WSIB) determines whether an injury is compensable and learn about some workplace injuries and occupational illnesses. The course covers how to properly file a claim\, and includes the timelines that are applicable. Worker and Employer obligations are covered as well as roles and responsibilities with respect to work reintegration.  Protections under other legislation are also discussed should a return to work plan not provide sufficient protection to a worker in a work reintegration program. Participants will learn the significance of legislation (WSIA)\, regulations and policy\, including changes to the legislation and the effects these changes have on benefits.

DESCRIPTION:This 1 day seminar examines writing formats for preparing a written submisison.  Participants discuss hearing options for appeals and the specific criteria considered when determining whether or not a written submission is appropriate. Important points of a written submission are discussed as they relate to the WSIAT Practice Direction for written submissions. Myths associated with oral hearings and how they can be used to improve writing skills begin an exploration of the differences between the two types of appeal. The traditional structure of the submission is explored with specific details for each section discussed. In addition to submissions\, this course also addresses writing to doctors and the effect the letter has both on the medical professional’s reply and on the decision maker on the file.  Seating is limited so book early to secure a spot.

DESCRIPTION:In this week-long course participants will examine medical testing and interpret medical information found in claim files.  They will learn medical terminology and human anatomy with attention to the different organ systems\, specific injuries involving the back\, bone\, MSI and disorders such as chronic pain and fibromyalgia.  Mental stress will be examined along with WSIB policies relating to traumatic stress\, psychotraumatic disability and behavioural disorders. DESCRIPTION:In this 6 day course\, participants will learn the structure of the appeals branch of the Workplace Safety and Insurance Board (WSIB)\, how to begin the appeals process and the legal principles involved. Preparation for a hearing will be examined including: review of the file\, gathering additional evidence\, researching law\, policy and precedent and preparation of witnesses. Further information on questioning\, cross questioning and re-direct at a hearing are discussed. Hearing presentations are discussed with respect to oral advocacy\, code of conduct\, opening and closing statements\, objections and use of legal precedents. Further to the WSIB appeal process\, the Workplace Safety and Appeals Tribunal WSIAT) process is also discussed. In addition to the information presented\, participants will work with a claim file and\, in groups\, represent both worker and employer interests at the WSIB appeal level and at a WSIAT by presenting in front of an Appeals Resolution officer and a Vice Chair respectively.

DESCRIPTION:The Workplace Insurance Level I course examines the history of the compensation system in Ontario and the development of compensation legislation and the general principles of the system. Participants will learn how the Workplace Safety and Insurance Board (WSIB) determines whether an injury is compensable and learn about some workplace injuries and occupational illnesses. The course covers how to properly file a claim\, and includes the timelines that are applicable. Worker and Employer obligations are covered as well as roles and responsibilities with respect to work reintegration.  Protections under other legislation are also discussed should a return to work plan not provide sufficient protection to a worker in a work reintegration program. Participants will learn the significance of legislation (WSIA)\, regulations and policy\, including changes to the legislation and the effects these changes have on benefits.

DESCRIPTION:The Workplace Insurance Level II course examines legislation (WSIA)\, regulations\, policy and recent legislative changes. The course also looks at the structure of the WSIB\, how it is funded\, incentive programs and the adjudication and appeals processes.  Participants will review benefits available under the Act that apply to three different eras.   They will also examine how to calculate maximum and minimum levels as well as exclusion periods and offsets.  The course provides information on how to communicate effectively with insurance and health care providers\, injured workers and witnesses involved in appeals.  The organization of a Board file is presented and participants explore how to effectively review a file\, make a case plan to proceed to move a claim forward and use this knowledge to review a case file.
